What is and isn’t included in the sale of a home isn’t always as clear as it should be. From small items like a bathroom mirror to large items like window treatments it can be hard to distinguish what is included and what isn’t. The seller may look at one feature in the home and see it as removable while a buyer could look at the same object and see it is a permanent fixture which should be included in the sale of the home. Fixtures are classified as features that are permanent and attached to the home. It is generally understood by both sides that fixtures are included in the sale but disagreements often can arise when defining which items are actually fixtures and what are not.
Communication is key in many situations but especially when buying or selling a home. Make sure to communicate with your agent so they know what is or is not included in the deal. To ensure you get what you want as a buyer there are standard residential purchase forms which typically have a section for buyers to list items they want to be included in the sale. As a buyer, a good time to talk to your agent about what you would like to be included in the sale is during a showing of the house – at the beginning of the buying process. If you really like the house because of the curtains, washer and dryer or chandelier make sure to tell your agent. If you are the seller before your house goes on the market make sure to tell your agent what is staying or leaving with you. Before drawing up a contract it should be made clear to both parties what will remain in the house. As a precaution, replace items you aren’t including before listing. If you want to take your ceiling fan or light fixtures swap them out before showing it to buyers.
